Prohibited Products Policy

1. General Rule

Sellers may only list products that:

• Are legal to sell.
• Can be lawfully owned.
• Can be legally transported.
• Do not infringe the rights of others.
• Meet applicable regulatory requirements.
• Are accurately described.
• Do not create unreasonable risk for Buyers.

Where a product is prohibited by law or this Policy, it may not be listed on LIYAD.

2. Illegal Products

The following products may never be listed on LIYAD:

• Stolen goods.
• Counterfeit identity documents.
• Fake driver's licences.
• Forged passports.
• Forged certificates.
• Forged permits.
• Fake academic qualifications.
• Government-issued identification documents.
• Police equipment intended for unlawful use.
• Illegal surveillance devices where prohibited by law.
• Products intended primarily to facilitate criminal activity.

Any attempt to sell illegal products will result in immediate enforcement action.

3. Counterfeit Goods

LIYAD prohibits the sale of counterfeit goods.

Examples include:

• Fake luxury handbags.
• Counterfeit watches.
• Counterfeit electronics.
• Fake cosmetics.
• Fake designer clothing.
• Counterfeit footwear.
• Replica products falsely represented as genuine.
• Products bearing unauthorized trademarks.

Products inspired by a brand may only be sold if they do not infringe intellectual property rights or mislead consumers.

Sellers must accurately describe replica, compatible or aftermarket products where legally permitted.

4. Intellectual Property Violations

You may not sell products that infringe another person's intellectual property rights.

Examples include:

• Copyright infringement.
• Trademark infringement.
• Patent infringement.
• Design infringement.
• Unauthorized reproductions.
• Bootleg merchandise.
• Unauthorized branded packaging.

LIYAD may remove listings upon receiving a valid intellectual property complaint.

Repeat infringement may result in permanent account termination.

5. Weapons

The following products are prohibited unless expressly permitted by applicable law and approved by LIYAD:

• Firearms.
• Handguns.
• Rifles.
• Assault weapons.
• Homemade firearms.
• Firearm frames or receivers.
• Ammunition.
• Explosives.
• Grenades.
• Military weapons.
• Rocket launchers.
• Missile systems.

In addition, products designed primarily to facilitate serious violence or unlawful harm are prohibited.

6. Dangerous Weapons

The following products may not be sold through LIYAD:

• Brass knuckles.
• Switchblades where prohibited by law.
• Butterfly knives where prohibited.
• Throwing stars.
• Concealed weapons disguised as ordinary objects.
• Explosive devices.
• Improvised explosive components.
• Booby traps.

Kitchen knives, camping equipment, multi-tools and lawful sporting equipment may be sold where permitted by applicable law and intended for legitimate use.

7. Explosives and Hazardous Devices

The following are prohibited:

• Fireworks requiring licences.
• Military explosives.
• Detonators.
• Bomb-making kits.
• Explosive chemicals.
• Fuses designed for explosives.
• Improvised explosive device components marketed for unlawful use.

Products that pose a serious public safety risk may be removed at LIYAD's discretion.

8. Controlled Drugs and Narcotics

The sale of illegal drugs is strictly prohibited.

Examples include:

• Cocaine.
• Heroin.
• Methamphetamine.
• Ecstasy.
• LSD.
• Psilocybin products where prohibited.
• Illegal cannabis products.
• Synthetic narcotics.
• Illegal steroids.
• Illegal performance-enhancing drugs.

LIYAD fully cooperates with law enforcement regarding illegal drug activity.

9. Prescription Medicines

Prescription-only medicines may not be sold unless:

• Permitted by applicable law.
• Sold by a licensed entity.
• Approved in writing by LIYAD where required.

Examples include:

• Prescription antibiotics.
• Prescription pain medication.
• Prescription weight-loss medication.
• Hormonal therapies.
• Prescription injections.
• Veterinary prescription medicines.

Sellers remain responsible for complying with all healthcare regulations applicable to their products.

10. Alcohol

The sale of alcoholic beverages through LIYAD is subject to applicable laws and licensing requirements.

Unless expressly approved by LIYAD and permitted by law, Sellers may not list:

• Spirits.
• Beer.
• Wine.
• Cider.
• Ready-to-drink alcoholic beverages.
• Home-brewing kits intended for unlawful use.

Where alcohol sales are permitted in the future, Sellers must:

• Hold all required licenses and permits.
• Comply with age verification requirements.
• Follow all advertising restrictions.
• Comply with applicable tax and excise obligations.
• Use approved delivery methods where legally required.

LIYAD reserves the right to prohibit alcohol sales entirely or restrict them by jurisdiction.

11. Tobacco, Nicotine and Vaping Products

Unless expressly approved by LIYAD and permitted by applicable law, Sellers may not list:

• Cigarettes.
• Cigars.
• Loose tobacco.
• Pipe tobacco.
• Nicotine pouches.
• Nicotine gum (where regulated).
• Electronic cigarettes.
• Vape devices.
• Vape cartridges.
• Nicotine liquids.
• Disposable vapes.
• Heated tobacco products.

Any future approval of nicotine-related products may require:

• Age verification.
• Regulatory compliance.
• Health warnings.
• Product registration where applicable.

12. Adult Products and Services

LIYAD is intended to be a marketplace suitable for a broad audience.

The following may not be listed:

• Pornographic material.
• Sexually explicit content.
• Adult videos.
• Escort services.
• Prostitution services.
• Sexual exploitation content.
• Non-consensual intimate material.
• Hidden recording devices intended for unlawful surveillance.

Certain adult wellness products may be permitted where lawful, accurately described and approved by LIYAD.

13. Gambling Products and Services

The following are prohibited unless specifically authorized by applicable law and approved by LIYAD:

• Gambling services.
• Betting services.
• Lottery ticket sales.
• Sports betting.
• Casino chips.
• Illegal raffles.
• Sweepstakes requiring unlawful participation.
• Unlicensed gambling software.

Promotional competitions conducted in accordance with applicable laws may be permitted.

14. Financial Scams and Fraudulent Services

Sellers may not offer products or services that facilitate fraud or financial deception.

Examples include:

• Fake investment schemes.
• Advance fee scams.
• Fake loan approvals.
• Identity theft services.
• Credit repair scams.
• Fake banking products.
• Counterfeit financial instruments.
• Fraudulent insurance products.
• Fake employment opportunities.
• Money laundering services.

Listings designed to deceive users will be removed immediately.

15. Cryptocurrency and Digital Asset Scams

While lawful blockchain-related products or educational materials may be permitted, the following are prohibited:

• Guaranteed investment returns.
• Ponzi schemes.
• Rug pull projects.
• Fake token sales.
• Fraudulent NFT projects.
• Fake cryptocurrency exchanges.
• Wallet recovery scams.
• Private key sales.
• Stolen digital assets.
• Fake mining services.

Sellers offering blockchain-related products remain responsible for complying with applicable financial regulations.

16. Pyramid Schemes and Illegal Business Opportunities

LIYAD prohibits listings promoting unlawful business models.

Examples include:

• Pyramid schemes.
• Chain recruitment schemes.
• Get-rich-quick schemes.
• Fake investment clubs.
• Recruitment-only compensation models.
• Referral scams.

Business opportunities must be lawful, transparent and accurately represented.

17. Network Marketing Products

LIYAD supports legitimate direct selling and network marketing businesses where permitted by law.

However, Sellers must not:

• Misrepresent potential earnings.
• Guarantee financial success.
• Use deceptive income claims.
• Require unlawful participation fees.
• Encourage illegal recruitment practices.
• Mislead Buyers regarding compensation structures.

Health, wellness and nutritional products sold through network marketing businesses must also comply with the Health Claims Policy and all applicable consumer protection laws.

18. Hazardous Chemicals

The following products are prohibited unless permitted by law and specifically approved by LIYAD:

• Toxic chemicals.
• Chemical weapon precursors.
• Industrial poisons.
• Dangerous pesticides.
• Corrosive substances.
• Restricted laboratory chemicals.
• Hazardous industrial waste.
• Explosive chemical mixtures.

Products posing unreasonable risks to public health or safety may be removed without notice.

19. Radioactive and Nuclear Materials

The following products are strictly prohibited:

• Radioactive substances.
• Uranium.
• Plutonium.
• Nuclear fuel.
• Radioactive waste.
• Radioactive isotopes intended for unauthorized use.
• Nuclear weapon components.

Educational materials relating to nuclear science may be permitted provided they do not facilitate unlawful activity.

20. Environmentally Harmful Products

Products that pose significant environmental risks may not be listed.

Examples include:

• Illegal wildlife products.
• Ozone-depleting substances prohibited by law.
• Illegal dumping services.
• Hazardous waste disposal services.
• Protected plant species sold unlawfully.
• Illegal logging products.
• Products obtained through environmental crime.

LIYAD supports environmentally responsible business practices and may remove listings that create unacceptable environmental risks.

21. Wildlife and Endangered Species

LIYAD prohibits the sale of products that violate wildlife protection or conservation laws.

Prohibited listings include:

• Endangered animal products.
• Ivory.
• Rhino horn.
• Tiger parts.
• Pangolin products.
• Protected bird species.
• Protected reptile species.
• Illegal hunting trophies.
• Illegal exotic pets.
• Products derived from endangered species.

Products must comply with all applicable conservation and wildlife protection legislation.

22. Human Body Parts and Biological Materials

The following may not be listed on LIYAD:

• Human organs.
• Human tissue.
• Human blood.
• Human remains.
• Human embryos.
• Biological samples intended for unlawful use.
• Genetic material offered without legal authorization.

Medical, scientific or educational products involving biological materials may only be offered where legally permitted and specifically approved where required.

23. Recalled, Unsafe and Defective Products

Sellers may not offer products that have been officially recalled or identified as unsafe.

Examples include:

• Government-recalled products.
• Unsafe children's toys.
• Products subject to mandatory safety recalls.
• Defective electrical products.
• Unsafe batteries.
• Products prohibited by consumer safety regulators.
• Expired safety-certified equipment.

Sellers are responsible for monitoring product recalls affecting their inventory.

Where a listed product becomes subject to a recall, the Seller must remove it immediately and cooperate with any required customer notification process.

24. Medical Devices

Medical devices may only be sold where permitted by applicable law.

Examples include:

• Blood pressure monitors.
• Glucose meters.
• Mobility aids.
• Hearing assistance devices.
• Medical braces.
• First-aid equipment.

The following are prohibited unless authorized by law and approved where required:

• Unregistered medical devices.
• Counterfeit medical devices.
• Devices making unsupported medical claims.
• Devices requiring regulatory approval that has not been obtained.

Sellers remain responsible for ensuring compliance with all applicable healthcare regulations.

25. Cosmetics and Personal Care Products

Cosmetic and personal care products must:

• Be legally permitted for sale.
• Be accurately described.
• Comply with applicable product safety regulations.
• Display required ingredient information where applicable.
• Not make misleading health or medical claims.

Examples include:

• Skincare products.
• Haircare products.
• Makeup.
• Perfumes.
• Soaps.
• Body lotions.

Counterfeit, contaminated or expired cosmetic products are prohibited.

26. Food, Beverages and Nutritional Products

Food-related products sold through LIYAD must comply with applicable food safety laws.

Sellers must not list:

• Expired food.
• Contaminated food.
• Adulterated products.
• Mislabelled food.
• Products subject to food safety recalls.
• Unsafe imported food.
• Products prohibited by food regulators.

Where nutritional supplements are sold, Sellers must ensure that all marketing complies with the LIYAD Health Claims Policy.

27. Digital Products

Digital products may be sold where they are lawful and the Seller has the necessary rights.

Examples include:

• E-books.
• Software licenses.
• Design templates.
• Educational courses.
• Music.
• Photography.
• Digital artwork.
• Printable documents.

The following are prohibited:

• Pirated software.
• Illegal activation keys.
• Copyright-infringing downloads.
• Unauthorized streaming subscriptions.
• Stolen digital accounts.
• Unauthorized access credentials.
• Hacked software.
• Circumvention tools intended for unlawful use.

28. Stolen Property

Sellers may not list:

• Stolen goods.
• Lost property that has not been lawfully recovered.
• Goods obtained through fraud.
• Goods obtained through theft.
• Property subject to criminal investigation.

LIYAD may remove listings and cooperate with law enforcement where stolen property is suspected.

29. Prohibited Services

Certain services may not be offered through LIYAD.

Examples include:

• Illegal hacking services.
• Distributed denial-of-service (DDoS) services.
• Fake document creation.
• Identity fraud services.
• Money laundering services.
• Academic cheating services.
• Sale of examination answers.
• Contract cheating.
• Fake reviews for third-party platforms.
• Illegal surveillance services.
• Services intended to facilitate unlawful activity.

Professional consulting, coaching, education and legitimate business services are generally permitted, provided they comply with applicable laws and Platform policies.

30. Seller Compliance Responsibilities

Every Seller is responsible for ensuring that products listed on LIYAD:

• Comply with applicable laws.
• Comply with this Policy.
• Comply with consumer protection legislation.
• Meet applicable safety requirements.
• Are accurately described.
• Are supported by required licenses or certifications where applicable.

LIYAD may request supporting documentation at any time, including:

• Business licenses.
• Product registrations.
• Safety certifications.
• Import permits.
• Regulatory approvals.
• Manufacturer authorizations.
• Certificates of authenticity.

Failure to provide requested documentation may result in removal of listings or further enforcement action.

31. Reporting Prohibited Listings

Users are encouraged to report listings that may violate this Policy.

Reports may relate to:

• Illegal products.
• Counterfeit goods.
• Dangerous products.
• Fraudulent listings.
• Intellectual property infringement.
• Unsafe products.
• Misleading health claims.
• Products prohibited by law.

32. Enforcement

LIYAD reserves the right to take enforcement action where products, services or listings violate this Policy.

Enforcement actions may include:

• Removal of listings.
• Temporary listing restrictions.
• Account warnings.
• Suspension of selling privileges.
• Permanent account termination.
• Withholding publication of new listings pending review.
• Referral to regulatory authorities where required.
• Cooperation with law enforcement agencies.

LIYAD may take immediate action where necessary to protect users, comply with legal obligations or prevent harm.

33. Listing Review

LIYAD may review listings:

• Before publication.
• After publication.
• Following user reports.
• During routine compliance reviews.
• Following regulatory enquiries.
• When suspicious activity is detected.

Reviewing listings does not mean LIYAD guarantees the legality, safety or quality of products.

Sellers remain solely responsible for ensuring that their listings comply with all applicable laws and Platform policies.

34. Listing Removal

LIYAD may remove listings where there is a reasonable belief that they:

• Violate this Policy.
• Violate applicable law.
• Infringe intellectual property rights.
• Present unreasonable safety risks.
• Mislead consumers.
• Facilitate fraud.
• Contain inaccurate or deceptive information.
• Harm the integrity of the Platform.

Where appropriate, LIYAD may notify the Seller of the removal and provide an opportunity to correct the issue.

Certain listings may be removed immediately without prior notice where required by law or where user safety is at risk.

35. Account Suspension

LIYAD may suspend Seller accounts where there is evidence of:

• Repeated prohibited listings.
• Fraudulent activity.
• Counterfeit goods.
• Dangerous products.
• Intellectual property infringement.
• Repeated consumer complaints involving serious misconduct.
• Attempts to circumvent Platform policies.
• Failure to cooperate with compliance investigations.

During a suspension, LIYAD may temporarily restrict access to:

• Seller dashboards.
• Product listings.
• New product uploads.
• Order management features.
• API access.
• Store administration tools.

36. Permanent Account Termination

LIYAD may permanently terminate accounts where:

• Serious violations occur.
• Illegal activity is confirmed.
• Fraud is established.
• Counterfeit goods are repeatedly sold.
• User safety is intentionally endangered.
• The Seller repeatedly ignores compliance requests.
• There is a material breach of the Seller Agreement or Terms of Service.

Termination may result in:

• Permanent closure of the Store.
• Removal of all listings.
• Revocation of API credentials.
• Restriction on creating future Seller accounts.
• Reporting to relevant authorities where legally required.

Termination does not affect obligations that arose before termination, including customer claims, legal proceedings or outstanding payment obligations.

37. Appeals

If a Seller believes enforcement action has been taken incorrectly, the Seller may submit an appeal.

Appeals should include:

• Store name.
• Seller account information.
• Product details.
• Explanation of the appeal.
• Supporting documentation.
• Any relevant regulatory approvals or certifications.

LIYAD will review appeals in good faith and may request additional information before reaching a decision.

Submitting an appeal does not guarantee reinstatement of a listing or account.

38. Regulatory Compliance

LIYAD reserves the right to cooperate with:

• Consumer protection authorities.
• Regulatory agencies.
• Customs authorities.
• Intellectual property rights holders.
• Law enforcement agencies.
• Courts.
• Government departments.

Where legally required, LIYAD may disclose information relating to prohibited listings or unlawful activity.

Such disclosures will be made in accordance with applicable privacy laws and our Privacy Policy.

39. Changes to this Policy

LIYAD may update this Prohibited Products Policy from time to time to reflect:

• Changes in legislation.
• Regulatory guidance.
• Industry standards.
• Marketplace developments.
• New product categories.
• Emerging risks.
• Platform improvements.

Material updates may be communicated through:

• Email.
• Dashboard notifications.
• Platform announcements.
• Trust Centre updates.

The latest version of this Policy will always be published in the LIYAD Trust Centre.

Continued use of the Platform after updates become effective constitutes acceptance of the revised Policy.

40. Governing Law

This Policy shall be governed by the laws of the Republic of South Africa.

It should be interpreted together with:

Nothing in this Policy limits any obligations imposed by applicable law.
