This Acceptable Use Policy ("AUP") explains the rules governing the use of the LIYAD Platform. The purpose of this Policy is to protect Buyers, Sellers, visitors and LIYAD by ensuring that the Platform remains secure, reliable and trustworthy. This Policy applies to every person or business that accesses or uses LIYAD, including Visitors, Buyers, Sellers, Administrators, Employees, Contractors, Developers, API users and Integration partners. This Policy forms part of the LIYAD Terms of Service. Failure to comply with this Policy may result in enforcement action, including suspension or termination of access to the Platform.

1. Purpose

LIYAD is committed to providing a marketplace that is:

  • Safe
  • Secure
  • Reliable
  • Professional
  • Respectful
  • Lawful

Every user shares responsibility for maintaining these standards.

2. General Principles

When using LIYAD you agree to:

  • Use the Platform lawfully.
  • Respect other users.
  • Respect intellectual property rights.
  • Protect your account.
  • Provide truthful information.
  • Use the Platform in good faith.
  • Comply with applicable laws.
  • Cooperate with legitimate investigations relating to abuse of the Platform.

3. Lawful Use

You may only use LIYAD for lawful purposes.

You must not use the Platform to:

  • Commit criminal offences.
  • Facilitate illegal transactions.
  • Promote unlawful activity.
  • Circumvent applicable laws.
  • Assist others in committing unlawful acts.

Users remain solely responsible for ensuring that their activities comply with the laws applicable to their jurisdiction.

4. Account Responsibilities

You are responsible for:

  • Maintaining accurate account information.
  • Keeping your password confidential.
  • Protecting access to your account.
  • Using strong passwords.
  • Promptly reporting unauthorized access.
  • Maintaining current contact information.

You must not:

  • Share accounts unless expressly permitted.
  • Sell access to your account.
  • Rent your account.
  • Transfer accounts without LIYAD's written approval.
  • Allow unauthorized persons to use your credentials.

5. Honest Representation

Users must provide truthful and accurate information.

You must not:

  • Use false identities.
  • Impersonate another person.
  • Impersonate another business.
  • Misrepresent qualifications.
  • Misrepresent products.
  • Misrepresent pricing.
  • Misrepresent availability.
  • Mislead customers.
  • Create fake business profiles.

Trust is fundamental to the LIYAD marketplace.

6. Respect for Other Users

You agree to interact respectfully with:

  • Buyers
  • Sellers
  • Support staff
  • Employees
  • Contractors
  • Other Platform users

The following behaviour is prohibited:

  • Harassment
  • Threats
  • Hate speech
  • Bullying
  • Intimidation
  • Discrimination
  • Abusive language
  • Defamation
  • Stalking

LIYAD encourages constructive, professional communication.

7. Platform Integrity

You must not interfere with the operation of the Platform.

Examples include:

  • Attempting to disable services.
  • Overloading servers.
  • Circumventing security controls.
  • Interfering with other users.
  • Disrupting Platform availability.
  • Exploiting software vulnerabilities.
  • Testing security without authorization.

Any attempt to compromise Platform integrity is treated as a serious violation.

8. Unauthorized Access

You must not attempt to gain access to:

  • Another user's account.
  • Administrative systems.
  • Databases.
  • Internal tools.
  • Source code.
  • Infrastructure.
  • APIs beyond your authorization.

Unauthorized access attempts include:

  • Password guessing.
  • Credential stuffing.
  • Brute-force attacks.
  • Session hijacking.
  • Privilege escalation.
  • Token theft.
  • Exploiting software vulnerabilities.

Attempting unauthorized access may result in immediate account suspension and referral to law enforcement where appropriate.

9. Malware and Harmful Code

Users must not upload, distribute or transmit:

  • Malware
  • Viruses
  • Worms
  • Trojan horses
  • Ransomware
  • Spyware
  • Keyloggers
  • Malicious scripts
  • Harmful executables

You must not intentionally introduce software designed to:

  • Damage systems.
  • Disrupt operations.
  • Access unauthorized information.
  • Interfere with Platform functionality.

LIYAD actively monitors for malicious activity to protect users and Platform infrastructure.

10. Spam and Unsolicited Communications

LIYAD is committed to maintaining a high-quality user experience free from unwanted or abusive communications.

You may not use the Platform to:

  • Send unsolicited marketing messages.
  • Distribute spam.
  • Send bulk messages without permission.
  • Harvest email addresses for marketing.
  • Send chain letters.
  • Send phishing emails.
  • Distribute misleading advertisements.
  • Send deceptive notifications.
  • Circumvent user communication preferences.

Marketing communications must comply with applicable laws and respect users' communication preferences.

11. Fraud and Deceptive Practices

Users must not engage in fraudulent, deceptive or dishonest conduct.

Examples include:

  • Creating fake orders.
  • Using stolen payment methods.
  • Identity theft.
  • Misrepresenting products.
  • Fake delivery confirmations.
  • False advertising.
  • Counterfeit goods.
  • Fake reviews.
  • Fake refund requests.
  • Insurance fraud.
  • Payment fraud.
  • Account takeovers.

LIYAD reserves the right to suspend accounts immediately where fraud is reasonably suspected.

12. Marketplace Manipulation

Users must not manipulate the operation or fairness of the marketplace.

Prohibited activities include:

  • Artificially inflating ratings.
  • Purchasing fake reviews.
  • Coordinating false reviews.
  • Manipulating search rankings.
  • Creating multiple accounts to influence marketplace activity.
  • Artificially inflating sales figures.
  • Coordinating fraudulent purchases.
  • Circumventing marketplace policies.

The integrity of reviews, ratings and marketplace rankings is essential to maintaining user trust.

13. Intellectual Property Infringement

Users must respect the intellectual property rights of others.

You may not:

  • Upload copyrighted material without permission.
  • Use another company's trademarks without authorization.
  • Copy product images without permission.
  • Reproduce copyrighted text.
  • Sell counterfeit products.
  • Distribute pirated software.
  • Infringe patents, trademarks, copyrights or design rights.

Users remain solely responsible for ensuring they have the necessary rights to publish or sell content through the Platform.

14. Automated Access and Scraping

Unless expressly authorized by LIYAD, users may not use automated tools to access the Platform.

Examples include:

  • Web scraping.
  • Automated crawling.
  • Data mining.
  • Screen scraping.
  • Automated account creation.
  • Automated purchasing bots.
  • Bulk data extraction.
  • Automated vulnerability scanning.

Reasonable indexing by recognized search engines is permitted where allowed by applicable technical controls.

15. API Usage

Where LIYAD provides APIs, users must use them responsibly.

You may not:

  • Exceed published rate limits.
  • Attempt to bypass API restrictions.
  • Abuse authentication mechanisms.
  • Use APIs for unlawful purposes.
  • Reverse engineer private APIs.
  • Access data outside your authorization.
  • Share API credentials.
  • Sell API access without permission.

LIYAD may monitor API usage to maintain Platform security and reliability.

16. Artificial Intelligence Usage

LIYAD may provide AI-powered tools to assist Buyers and Sellers.

Users must not use AI features to:

  • Generate unlawful content.
  • Produce fraudulent advertisements.
  • Impersonate individuals.
  • Generate deceptive product listings.
  • Circumvent Platform policies.
  • Produce malicious code.
  • Harass or intimidate users.
  • Spread misinformation.
  • Violate intellectual property rights.

Users remain responsible for reviewing AI-generated content before publishing or relying upon it.

17. Data Harvesting

You must not collect or extract user information without authorization.

Examples include harvesting:

  • Email addresses.
  • Telephone numbers.
  • Customer lists.
  • Seller information.
  • Personal Information.
  • Business information.
  • Payment information.
  • Account details.

Unauthorized harvesting of information may violate privacy laws and these Terms.

18. Security Testing

Security research helps improve the Platform when conducted responsibly.

If you identify a potential security vulnerability, you should:

  • Avoid exploiting the vulnerability beyond what is necessary to confirm its existence.
  • Avoid accessing data belonging to other users.
  • Report the issue to LIYAD promptly.
  • Provide sufficient technical detail to assist our investigation.
  • Allow LIYAD a reasonable opportunity to investigate and address the issue before publicly disclosing it.

Unauthorized penetration testing, exploitation or disruption of Platform systems is prohibited unless expressly authorized in writing by LIYAD.

19. Reporting Abuse

Users are encouraged to report suspected violations of this Acceptable Use Policy.

Examples include:

  • Fraudulent Sellers.
  • Fake Buyer accounts.
  • Intellectual property infringement.
  • Counterfeit products.
  • Malware.
  • Spam.
  • Harassment.
  • Security incidents.
  • Privacy violations.

LIYAD will review reports in good faith and may request additional information where necessary.

20. Enforcement

LIYAD takes violations of this Acceptable Use Policy seriously.

Where we reasonably believe that a user has violated this Policy, we may take one or more enforcement actions to protect the Platform, its users and our business.

Enforcement actions are determined based on factors including:

  • Severity of the violation.
  • Risk posed to users.
  • Previous violations.
  • Intent.
  • Applicable legal obligations.
  • Potential harm to the Platform.

LIYAD reserves the right to act immediately where necessary to prevent fraud, security incidents or unlawful activity.

21. Investigation Process

Where suspected violations are identified, LIYAD may investigate by reviewing relevant information including:

  • Account activity.
  • Login history.
  • Transaction records.
  • Product listings.
  • Communication records submitted through the Platform.
  • API activity.
  • Security logs.
  • Audit trails.
  • Technical logs.

Investigations are conducted only to the extent reasonably necessary to determine whether this Policy has been violated and to protect the integrity of the Platform.

LIYAD will handle investigation information in accordance with its Privacy Policy and applicable law.

22. Temporary Restrictions

During an investigation, LIYAD may temporarily restrict certain Platform features where reasonably necessary.

Restrictions may include:

  • Preventing new product listings.
  • Temporarily disabling purchases.
  • Restricting withdrawals (where applicable).
  • Limiting API access.
  • Requiring identity verification.
  • Restricting administrative actions.
  • Disabling integrations.
  • Requiring password resets.

Temporary restrictions are intended to protect the Platform while investigations are completed and do not necessarily indicate wrongdoing.

23. Account Suspension

LIYAD may suspend an account where there is reasonable evidence of:

  • Fraudulent activity.
  • Security threats.
  • Repeated policy violations.
  • Serious abuse of the Platform.
  • Distribution of malware.
  • Intellectual property infringement.
  • Identity misrepresentation.
  • Payment fraud.
  • Illegal product listings.
  • Attempts to compromise Platform security.

Where reasonably practicable, LIYAD will notify the affected user of the suspension and provide information about the next steps.

Immediate suspension may occur without prior notice where necessary to protect users, the Platform or comply with legal obligations.

24. Account Termination

LIYAD may permanently terminate accounts where:

  • Serious violations occur.
  • Repeated violations continue after warnings.
  • Criminal activity is identified.
  • Fraud is confirmed.
  • The Platform is repeatedly abused.
  • There is a material breach of the Terms of Service.

Termination may result in:

  • Permanent loss of Platform access.
  • Removal of listings.
  • Closure of Stores.
  • Revocation of API credentials.
  • Removal of user-generated content where appropriate.
  • Restriction from creating future accounts.

Termination does not affect obligations that arose before termination, including payment obligations, legal claims or investigations.

25. Cooperation with Law Enforcement

LIYAD may cooperate with:

  • Law enforcement agencies.
  • Regulatory authorities.
  • Courts.
  • Government departments.
  • Financial institutions.

where required by applicable law or lawful legal process.

Examples include investigations involving:

  • Fraud.
  • Identity theft.
  • Counterfeit goods.
  • Money laundering.
  • Cybercrime.
  • Intellectual property infringement.
  • Payment fraud.
  • Other criminal offences.

Where legally permitted, LIYAD may notify affected users before disclosing information.

26. User Cooperation

Users are expected to cooperate reasonably with legitimate investigations.

You may be asked to:

  • Verify your identity.
  • Confirm ownership of an account.
  • Provide supporting documentation.
  • Explain unusual account activity.
  • Confirm business information.
  • Respond to security-related questions.

Failure to cooperate may delay the resolution of an investigation or result in further enforcement action where appropriate.

27. Appeals

If you believe enforcement action has been taken in error, you may submit an appeal.

Appeals should include:

  • Your account information.
  • A description of the issue.
  • Any supporting evidence.
  • Relevant order or transaction references, where applicable.

LIYAD will review appeals in good faith and may request additional information before reaching a decision.

Submitting an appeal does not guarantee that the original decision will be reversed.

28. Record Retention

LIYAD may retain records relating to Policy violations where reasonably necessary for:

  • Security investigations.
  • Fraud prevention.
  • Legal compliance.
  • Regulatory obligations.
  • Dispute resolution.
  • Audit purposes.

Retention periods are determined in accordance with applicable laws and our Privacy Policy.

29. Limitation of Liability

To the fullest extent permitted by law, LIYAD shall not be liable for losses arising from enforcement actions taken in good faith to:

  • Protect users.
  • Maintain Platform security.
  • Prevent fraud.
  • Comply with legal obligations.
  • Investigate suspected violations.
  • Preserve Platform integrity.

Nothing in this Policy excludes liability that cannot legally be excluded under applicable law.

30. Indemnification

You agree to indemnify and hold harmless LIYAD, its directors, employees, affiliates, contractors and service providers against claims, damages, liabilities, costs and expenses arising from:

  • Your violation of this Acceptable Use Policy.
  • Your unlawful conduct.
  • Your misuse of the Platform.
  • Your infringement of another person's rights.
  • Your breach of applicable laws.

This indemnity applies only to the extent permitted by applicable law.

31. Changes to this Acceptable Use Policy

LIYAD may amend this Acceptable Use Policy from time to time to reflect:

  • Changes in applicable laws and regulations.
  • New Platform features.
  • Emerging security threats.
  • Industry best practices.
  • Operational improvements.
  • New technologies.
  • Changes to our services.

Where material changes are made, LIYAD may notify users through one or more of the following methods:

  • Email notifications
  • Dashboard announcements
  • Platform notifications
  • Updates published within the Trust Centre

The latest version of this Policy will always be available on the LIYAD Platform.

Your continued use of the Platform after the effective date of an updated Policy constitutes acceptance of the revised Policy.

32. Responsible Security Disclosure

LIYAD encourages responsible disclosure of legitimate security vulnerabilities.

If you discover a security issue, we ask that you:

  • Report it privately to LIYAD.
  • Provide sufficient technical information to reproduce the issue.
  • Avoid exploiting the vulnerability beyond what is reasonably necessary to confirm its existence.
  • Avoid accessing, modifying or deleting data belonging to other users.
  • Allow LIYAD a reasonable opportunity to investigate and remediate the issue before publicly disclosing it.

33. Governing Law

This Acceptable Use Policy shall be governed by the laws of the Republic of South Africa.

Where applicable, this Policy should be interpreted together with:

  • The LIYAD Terms of Service
  • The Protection of Personal Information Act, 2013 (POPIA)
  • The Electronic Communications and Transactions Act (ECTA)
  • The Consumer Protection Act, 2008 (CPA)
  • Other applicable legislation governing electronic commerce and online services

Nothing in this Policy limits any rights or obligations imposed by applicable law.

34. Severability

If any provision of this Acceptable Use Policy is determined to be invalid, unlawful or unenforceable by a court or competent authority, that provision shall be interpreted as closely as possible to its intended purpose.

The remaining provisions shall remain valid and enforceable.

35. No Waiver

Failure by LIYAD to enforce any provision of this Policy shall not constitute a waiver of that provision or any other rights.

Any waiver must be made expressly and in writing by an authorized representative of LIYAD.

36. Entire Agreement

This Acceptable Use Policy forms part of the legal framework governing use of the LIYAD Platform.

Where there is any inconsistency between this Policy and mandatory provisions of applicable law, the applicable law shall prevail.

By creating an account, accessing the Platform, operating a Store or otherwise using LIYAD, you acknowledge that you have read, understood and agree to comply with this Acceptable Use Policy.

Failure to comply with this Policy may result in enforcement action as described above.

Platform responsibility statement

LIYAD is a software platform that enables independent sellers to create and manage online stores. LIYAD is not the seller of products listed on the platform. Unless LIYAD is explicitly identified as the merchant for a specific transaction, it does not manufacture, own, warehouse, inspect, guarantee, endorse or deliver products sold by independent sellers. Each seller is solely responsible for product quality, pricing, legal compliance, fulfilment, customer support, refunds, warranties and tax obligations.
